Abstract :\ The issue of the environment is one of the most important topics of the hour, as it poses a set of problems at the national and international levels, which in turn occupied the attention of jurists, researchers and scientists, and this came as a result of its strong connection with the elements of the environment, in addition to the negative effects of the behavior of individuals on the natural environment, so it was necessary to impose measures Precautionary deterrent in the field of environmental protection. The Algerian legislator, in an attempt to establish and strengthen the legal and institutional system for the protection of the environment, introduced an arsenal of laws, the first of which was in 1983, which was amended by Law No. 03/10 related to the protection of the environment within the framework of sustainable development
